These Terms & Conditions apply when you use the SmartPocket website or buy products from us. We have tried to keep them as clear and straightforward as possible.

By placing an order with us, you agree to these Terms & Conditions.

Our online store is hosted by Shopify, which provides the ecommerce platform we use to sell our products.

2. Our products

We take reasonable care to ensure that product descriptions, photographs, dimensions and other information on our website are accurate.

Colours and appearance may vary slightly depending on your device or screen settings. Minor variations may also occur between products where appropriate to the materials or manufacturing process.

Nothing in these Terms affects your statutory rights. Products we supply must be as described, of satisfactory quality and fit for purpose as required by UK consumer law.

We may change or discontinue products or update product information without notice. Any changes will not affect orders we have already accepted.

3. Placing an order

When you place an order, you are offering to buy the products in your basket.

After you place your order, we will send you an order confirmation by email. A contract between you and SmartPocket is formed when we accept your order.

We reserve the right to refuse or cancel an order where reasonably necessary, for example if:

• a product is unavailable;

• there has been an obvious pricing or product information error;

• we are unable to authorise or process payment;

• we cannot deliver to the address provided; or

• we reasonably suspect fraud or misuse of our website.

If we cancel an order after payment has been taken, we will refund the amount you have paid.

Please check your order and delivery details carefully before submitting your order.

4. Prices and payment

All prices are shown in pounds sterling (£).

Prices include VAT where VAT is applicable unless clearly stated otherwise.

Any delivery charges will be shown before you complete your purchase.

The total amount you need to pay will be displayed at checkout before you place your order.

We may change our prices at any time, but price changes will not affect orders we have already accepted.

Payment is taken using the payment methods available at checkout.

5. Delivery

We will deliver your order to the address you provide when placing your order.

Estimated delivery times are shown on our website or during checkout. While we will make reasonable efforts to deliver within those times, occasional delays may occur for reasons outside our control.

Unless we agree otherwise with you, goods will be delivered without undue delay and within 30 days of your order.

The products remain our responsibility until they are delivered to you, or to another person you have identified to receive them on your behalf.

If your parcel is lost or damaged before delivery, please contact us at smartpocketuk@gmail.com so that we can investigate and arrange an appropriate solution.

6. Cancelling your order and changing your mind

If you are a consumer purchasing online, you normally have the right to change your mind and cancel your order within 14 days of receiving your goods, without giving us a reason.

To cancel, contact us at smartpocketuk@gmail.com within the 14-day cancellation period.

Once you tell us that you wish to cancel, you must return the goods to us within 14 days.

Unless the goods are faulty, damaged or incorrect, you will normally be responsible for the cost of returning them.

You may inspect the product in the same way that you reasonably could in a shop. We may reduce your refund if the product has been handled beyond what is necessary to establish its nature, characteristics and functioning and its value has been reduced as a result.

We will make any refund due to you within the timescales required by law. We may wait until we have received the returned goods or you provide evidence that you have sent them back, whichever happens first.

Where required by law, we will also refund the standard delivery charge you paid to receive the goods. If you selected a more expensive delivery option, we are not required to refund the additional cost above our standard delivery service.

7. Faulty, damaged or incorrect products

We want you to be happy with your SmartPocket.

If your product arrives damaged, is faulty, is not as described or you receive the wrong product, please contact us at smartpocketuk@gmail.com as soon as possible.

We will deal with the issue in accordance with your rights under UK consumer law.

Nothing in these Terms or our Refund & Returns Policy limits your statutory rights.

8. Using our website

You may use our website for lawful, personal purposes.

You must not:

• use the website for fraudulent or unlawful purposes;

• attempt to interfere with the operation or security of the website;

• introduce viruses or other malicious software;

• misuse or attempt to gain unauthorised access to our website or systems; or

• copy or commercially exploit our website or its content without our permission.

We may suspend access to the website where reasonably necessary for security, maintenance or technical reasons.

9. Intellectual property

Unless otherwise stated, the SmartPocket name, branding, product designs, website content, photographs, graphics, text and other original material on our website belong to us or are used by us with permission.

You may view and use the website for your own personal, non-commercial purposes.

You must not reproduce, copy, distribute, modify or commercially use our content without our prior permission, except where permitted by law.

Shopify and other third-party names and trademarks belong to their respective owners.

10. Third-party services and links

Our website may use services provided by third parties or contain links to third-party websites.

We are not responsible for the content, availability or practices of websites operated by third parties. If you choose to use a third-party website or service, its own terms and privacy policies may apply.

Our store is hosted by Shopify. Purchases made through our store are made from SmartPocket, not Shopify.

11. Privacy

We take your privacy seriously.

Information about how we collect, use and protect your personal information can be found in our Privacy Policy [LINK].

Because our store is hosted by Shopify, Shopify also processes certain personal information in connection with providing the ecommerce platform.

12. Reviews and feedback

If you choose to send us a review, photograph, comment or other feedback, you confirm that you have the right to provide it and that it does not infringe another person's rights.

Where you submit content for publication or promotional use, you give us permission to use, reproduce and display that content in connection with SmartPocket and our marketing.

We will not knowingly publish unlawful, defamatory or infringing material and reserve the right to remove content where appropriate.

13. Our liability

Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

Our products are supplied for domestic and private use. If you use a product for commercial or business purposes, we will not be responsible for business losses such as loss of profit, revenue, business or business opportunity, to the extent permitted by law.

Nothing in this section affects your statutory consumer rights.

14. Events outside our control

We will not be responsible for a delay or failure to perform our obligations where this is caused by circumstances outside our reasonable control.

If such an event significantly affects your order, we will contact you where reasonably possible and take reasonable steps to minimise the impact.

Your statutory rights will continue to apply.

15. Changes to these Terms

We may update these Terms occasionally, for example to reflect changes to our business, website or the law.

The Terms that apply to your purchase will be those in force when you place your order.

The latest version will always be available on our website.

16. Governing law

These Terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you will also retain any mandatory consumer protections and rights available to you under the laws applicable where you live.

Nothing in these Terms limits any rights you have as a consumer to bring proceedings in the courts available to you under applicable law.
